I used to have this delusional notion that people who frequented Townhall were both conservative and intelligent. Guess I was wrong on that one... I can't believe the tenor of the comments on Ben Nelson's sellout, when a few senators are irrevocably changing our future, with no regard for the opinions of the citizenry. Can we please quit the partisan bickering and focus on the fundamentals?
The Bill of Rights says the following:
Ninth Amendment – Protection of rights not specifically enumerated in the Bill of Rights.
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
Tenth Amendment – Powers of States and people.
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
OK, I do not see anywhere in the Constitution where the Senate and House are given the power to impose upon the citizenry a mandate to buy a particular product (here, insurance) or to create a new infrastructure in place of one that the free market has created (here, health care). The current health care debate and ultimately, the laws resulting from it, clearly violate the intent and the wording of the Constitution and its amendments. Pelosi brushes off questions about the constitutionality of what she (along with Reid and Obama) are trying to push into law, but they are all on very shaky legal grounds.
We may be marginalized in congress because of arrogance and numbers, but the Constitution is on our side. If they manage to get this thing passed, as I am sure they will in some form, we, the Loyal Opposition, need to focus our efforts on nullifying this legislation on the grounds of the 9th and 10th amendment proclamations of states' rights. I don't pretend to know how to do that, but I am sure that Hugh Hewitt and other Townhall experts do know. We need to get this on the front burner immediately, before Obama packs the Supreme Court with his cronies!
